STORE POLICY

Please read these terms and conditions carefully before placing your order and retain a copy of these terms and your order for future reference.

These terms and conditions apply to your use of the InAvati website and by accessing this website, you agree to be bound by these terms and conditions set out below. if you do not agree to be bound by these terms and conditions you may not use or access this website. if there is anything you do not understand please email any enquiry to us at:

InAvati (the company, hereafter referred to as ‘we’) reserve the right to revise these terms and conditions.

PURCHASE OF GOODS

No contract exists between you and us for the sale of the goods until we have received your order and payment for it. Once you do this, there is a binding legal contract. We reserve the right to reject without notice any order to purchase the goods made by you at any time.

The description and price of the goods you order will be as shown in the product description at the website.

COLOURS

We cannot guarantee that colours on the website are fully equivalent to the items’ actual colours. This depends partly on the colour settings of your computer and monitor.

PAYMENT AND PRICES

We accept the following payment methods*:

- PayPal. (When you use PayPal your financial information is kept private, and every PayPal payment is followed by an email confirming the transaction. If you have a registered PayPal account, you can choose this for purchase without typing your credit card information.)

– Credit cards. (You can also pay by credit and debit cards – VISA, Master Card, AMEX and others. If you are experiencing any problems, please contact us directly.)

– Paysera. (A leading online payment provider in the Baltic region. Using this system you may accept payments via more than 20 different online payment types, including e-banking systems in the Baltics, the UK, Germany and Poland, international payments in euros all over the world.)

– Direct bank transfers.

*Please note that depending on a country in which you live all these payment methods can be available for you or only some of them. 

Payment will be debited and cleared from your account before the dispatch of the goods to you.

Shipping costs will be added to your order.

The price of the goods and delivery charges are inclusive of VAT but please take a note that orders to countries outside the European Union (EU) may be subject to additional VAT, import duties and/or taxes, which are levied once your package reaches your country. InAvati ships your package according to Delivered Duty Unpaid (DDU) Incoterm, which means we do not collect VAT, duties and/or taxes on orders to countries outside the EU and we cannot predict what your particular charges may be. If you do incur any such additional charges, they must be paid in order for your package to clear customs. Please contact your local customs office for more information.

SHIPPING

All orders are fulfilled at our head office in Vilnius, Lithuania within 1–2 business days after receiving the paid order. We operate from Monday to Friday but not on public holidays. If we don’t have your ordered item in stock we will inform you, and refund you immediately. 

When your order is placed, we will send you a preliminary confirmation. Once your package is shipped, we will send you an email with final confirmation and instructions on how to track and collect it.

Products to Lithuania are shipped via DPD courier (home delivery) or parcel machine (delivery to the selected parcel machine) services.

Standard EU shipping is provided by DPD courier delivery service (home delivery).

Standard worldwide shipping is provided by DHL Global Mail. DHL Global Mail picks up your order from our warehouse, sorts it, applies the necessary postage and handles the order until it reaches your country. Once the order arrives in your country, it is handed to your local post office for customs processing (if needed) and delivery. The delivery is made by your national postal service, not DHL Global Mail. 

Express worldwide shipping is provided by DHL Express.

Delivery times for standard shipping depend on your local postal service and may vary significantly. Use the express shipping service if you want to avoid delays. Usual shipping terms: Lithuania – up to 2 business days; EU – up to 6 business days; other countries – up to 10 business days (possible customs handling can add days to expected delivery dates).

No compensation is payable for delays. Once a reasonable period for delivery has passed, and in the absence of any information on where an item is, we may determine the item to be lost and a claim for loss may be made.

Please note that we do not include insurance in the basic shipping costs. If you would like to add insurance to the shipping of your item, please let us know in advance.

EXCHANGES AND REFUNDS

For 14 days following the delivery of your order, you may request the exchange or refund of items. Returns will only be accepted if the goods are in perfect condition. InAvati cannot accept returns where these requirements have been breached.

You are responsible for the shipping of returned items back to InAvati. Items lost in transit will not be compensated for.

Shipping charges on returned merchandise are at the customer s expense. However, InAvati will not charge additional shipping on exchanges. Refunds for returned merchandise will be made within two weeks of the return of the product, to the original purchaser credit card or other means (depending on payment method used). Note that additional duties and/or taxes will not be refunded, nor will shipping costs. For countries within the EU, VAT will be included in the refund. All exchanges are subject to availability.

Faulty items will be exchanged for the same type of product in the same size, subject to availability. Refunds for faulty items can be made within the 14-day period following delivery.

UNCOLLECTED ITEMS

Shipping costs will not be refunded for uncollected items.

PRIVACY POLICY

All personal information saved at the site will be handled with most care. The information that we store will not be sold or used for any purposes other than making sure you get the best service possible. It will solely be used for informing you about special offers and other marketing activities related to the different units of InAvati. Your personal data may be disclosed to third parties only when it is necessary to fulfil the purposes described above. When placing your order, you have the option not to receive any information from InAvati. If you wish to end your subscription to information from InAvati, you may send an email to info@inavatishop.com. State your name and email address and a short description of the matter in the email message.

You have the right at any time to know what information is kept about you in our systems. This information can be requested by sending an email to info@inavatishop.com. If the information is incomplete or incorrect, you have the right to have the information corrected or deleted.

COOKIES

Our site, like many others, uses small files called cookies to help us customize your experience. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We also use cookies to help us compile aggregate data about site traffic and site interaction, so that we can offer better site experiences and tools in the future.

We use cookies to:

  • help remember and process the items in the shopping cart;
  • understand and save users’ preferences for future visits.

You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (such as Internet Explorer) settings. Each browser is a little different, so look at your browser's Help menu to learn the correct way to modify your cookies.

If you disable cookies, some features will be disabled. It will turn off some of the features that make your site experience more efficient and some of our services will not function properly.

However, you still can:

  • place orders
  • remember items in a shopping cart
  • contact customer services over the telephone.

THIRD PARTY DISCLOSURE

We do not sell, trade or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business or servicing you, as long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property or safety. 

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising or other uses.

SECURITY

For security reasons, we do not store any payment information in our database.

DISCLAIMER

We do not guarantee that all the items available at the InAvati web shop are in stock at the time of your order. In the case of insufficient stock balance affecting your order, we will contact you shortly by phone or by email.

InAvati cannot warrant that the content of the site is at all times free of inaccuracies or typographical errors. Neither can we guarantee that all information is up to date. InAvati may at any time change the content of the site.

Though InAvati strives to always display the correct texts, images and pricing on the site and web shop, errors can occur. If you have been charged the wrong amount when shopping from the web shop, we will give you the option of placing a new order with the correct price or cancelling your order. If we are unable to get in touch with you, your order will be automatically cancelled.

Part of the services mediated through the site are performed by and are the responsibility of outside organizations. In situations where InAvati acts as agent for such services, we cannot be held responsible for any errors resulting from their activities.

InAvati cannot be held responsible for any damage caused from using the site or for not being able to use the site. InAvati cannot guarantee a problem-free uninterrupted and secure access to the site.

Hyperlinks on this website may refer to websites of third parties for which InAvati takes no responsibility. Therefore, InAvati has no information that the content of websites of third parties is correct.

OUT-OF-COURT DISPUTE RESOLUTION

If you are not satisfied with InAvati’s answer to your written claim, you can make a request/complaint regarding the purchased goods from the InAvati web shop to the State Consumer Rights Protection Authority (Vilniaus str. 25, Vilnius 01402, email tarnyba@vvtat.lt, phone 85 262 67 51, fax. (85) 279 1466, website www.vvtat.lt) – or complete an application form on the EGS platform http://ec.europa.eu/odr/.

APPLICABLE LAW

These terms and conditions are governed by and construed in accordance with the laws of the Republic of Lithuania; the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. All disputes shall be resolved in courts of Vilnius (Lithuania). You may also bring a claim to enforce your consumer protection rights in connection with the store policy in Lithuania or in the EU country in which you live.

AMENDMENTS TO THE TERMS AND CONDITIONS

We reserve the right to make changes to our website, and the terms and conditions. You will be subject to the terms and conditions in force at the time that you order products from us, unless any change to those terms and conditions is required to be made by law or government authority (in which case it may apply to orders previously placed by you). If any of these terms and conditions is deemed invalid, void or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
